Our Puppy Contract

 The PokePom Kennel/ T. Ho (“ADOPTEE”) and the undersigned _______________________________________________________________ (“ADOPTER”), in consideration of the mutual promises made in this Agreement and other good and valuable consideration, intending to be legally bound by this Agreement, agree to the following: 

Health Guarantee. The PokePom Kennel guarantee that the pet is in good health at the time of sale, free from any life-threatening congenital defects/infectious disease (i.e. Heart, Liver, Kidney, Parvo, etc.) This guarantee is valid for three (3) days once in ADOPTERs care. ADOPTER is responsible for taking pet to a licensed veterinarian within three days of possession to continue the health guarantee until the pet’s first birthday. Send in documentation as proof in order to activate guarantee. This guarantee does not apply to adult/retired pets. Adult/Retired Pets are sold as is.

1. Adoption Fee. An Adoption fee of $ _________ with a deposit of $150 is required for the pet to help defray any veterinary costs, housing costs and food expenses. The adoption fee and deposit are not refundable under any circumstances. If the ADOPTER chooses to withdraw from adoption within 72 hours of decision, then deposit may be transferred to another animal. 

2. No representations. The ADOPTEE is making no representations or warranties about the condition, personality, or temperament of the pet. This pet is being sold for domestic purposes only. ADOPTEE does not guarantee: the ability to breed, size, coat color or consistency, confirmation, or disposition of pet at maturity. Health guarantee does not cover hypoglycemia, coccidiosis, giardia, allergies, respiratory infections, luxating patellas, internal/external parasites or any other nonlife-threatening conditions (ones that can be prevented OR traits that are not life threatening) once the puppy has left our care. Diseases contracted due to lack of diligence of vaccinations once they have left our care are also not covered. 

3. Care of the Pet. ADOPTER warrants that the pet will be kept in appropriate conditions for its health and welfare and shall not be neglected in any manner. ADOPTER agrees that he/she is not acting as an agent in the purchase of this pet and at no time shall the pet described herein be sold to a pet shop without ADOPTEE consent. ADOPTER agrees never to use the pet for fighting or any other “sport” in which one animal is pitted against another, and never to beat or taunt the pet in order to promote aggressive characteristics. 

4. Veterinary care. ADOPTER agrees to have pet examined by a licensed veterinarian within three days of adoption. In case of illness or injury, ADOPTER agrees to seek prompt veterinary care. ADOPTER agrees to keep all required vaccinations current, including but not limited to Rabies and Distemper, and ensure that the pet receives preventative medication to protect against heartworm. ADOPTER consents to the ADOPTEE inquiring with ADOPTER’S veterinarian about the pet after adoption in times of illness or injury. 

4a. Congenital Conditions. This applies to pets bred at The PokePom Kennel. ADOPTER agrees to notify ADOPTEE the same day as initial vet visit and provide documentation. ADOPTEE will replace the pet with one (as soon as available) of equal or lesser value upon return of the original pet, registration paperwork, and written documentation and reports from the examining veterinarian. Note: If there is a pet you desire that costs more than your purchase, you may pay the difference if pet is available. Genetic results from on-line sellers will not be accepted as a diagnosis. 4b. Death of pet. If the pet passes within the first year of life, then a replacement pet will be offered after (a) necropsy exam is completed and documented by a licensed veterinarian and submitted to the ADOPTEE, (b) it is found pet passed from a congenital defect, and (c) medical records are submitted from initial vet visit that is dated within the first week of adoption up until death within the first year. 

5. Transfer and Euthanasia. ADOPTER agrees not to abandon, give away, sell, or dispose of the pet in any way, and ADOPTEE shall be notified at any or such time where ADOPTER determines that he/she is no longer able or desires to keep and care for the pet so that the ADOPTEE can re-claim the pet and arrange for another adoption. ADOPTER agrees that he/she may never surrender the pet to an animal shelter or rescue, which engages in the practice of euthanizing surplus pets. ADOPTER agree never to euthanize the pet expect in cases of terminal illness, injury, or old age accompanied by pain and suffering, and in that case, the euthanasia must be performed by a licensed veterinarian. 

6. Lost pet. ADOPTER agrees to use his/her best efforts to find pet if it becomes lost by immediately (a) filing lost pet reports with local police, animal control authorities, animal shelters, and local veterinarians, and (b) posting lost pet signs, and (c) contacting the ADOPTEE for additional service or assistance. 

7. Limited Registration or No Papers Clause. If pet is sold with “Limited” registration, then it is understood by the ADOPTER that the pet is not wanted for breeding purposes. Registration will either be given at the time of adoption with “Limited” marked or held until proof of spay/neuter. Proof of spay/neuter must be provided by a licensed veterinarian. ADOPTER gives consent for ADOPTEE to verify spay/neuter with the licensed veterinarian. 

7a. If, at a later date, the ADOPTER decides that “Full” registration is wanted, then an additional $300 may be paid given (a) there is nothing that would make the pet unfit, (b) if pet is female, then a licensed veterinarian must submit documentation verifying pet is a minimum of 5 pounds. ADOPTER understands that there may be a penalty for delayed registration with selected registry. 

8. Transportation. ADOPTER is responsible for all transportation fees associated with pet. It is expected that ADOPTER meets ADOPTEE at a designated location to transfer pet. If shipping is requested, then ground shipping and flight nanny may be available. Fees vary. 

9. Payment. Payment methods accepted include Zelle, Cash (if remaining amount is $100 upon pick up), Money Order/Cashier’s Check (MUST BE CLEARED IN ADVANCE), and Cash App (Deposit Only). PayPal is no longer accepted. No Personal Checks. Total amount due for pet must be received the day before pick up or morning of agreed date. 

10. Liability, Entire Agreement; Modifications; Binding Effect. This Agreement is the final agreement between The PokePom Kennel and (“ADOPTER”), and supersedes any prior understandings between The PokePom Kennel and (“ADOPTER”) with respect to the subject matter of this Agreement. No modifications of this Agreement will be valid unless in writing duly signed by both ADOPTER and 

(“ADOPTER”). This Agreement is binding upon ADOPTER and ADOPTER’S heirs, assigns, successors, personal representatives and executors. The PokePom Kennel and representatives are not liable for any claims, legal actions, losses, injuries, damages, costs, expenses or liabilities whatsoever in connection with this adoption or ownership of the pet.
